Hand Break one wheel locking

I am having problems with the hand break on my 7th gen diesel

I've had the car for about 3 months and the previous owner had the driver side hand break cable, rear pads and disks replaced.

I noticed that the hand break was't braking very good and tried tightening the setting from the console

But then While driving the passenger's side was braking and disks/rim became very hot, so I had to loose the nut from the console

Then I checked underneath the car and noticed that the adjustment is different and on the passenger's side there is a lot of distance compared to the driver's side.

I tried to loose the bolts to set them equally but did not manage to put them the same :S

any ideas where the problem might be?

Are the handbrake shoes identical, one side could be new and other old, AND ARE ADJUSTED CORRECTLY? I burned out my disc's pads, and shoes due to an overzealous "techie" reducing the "clicks" on the lever he took the them down to three, should be at about six, mind you he replaced them FOC, and had to humble pie as well. LOL

Sorry I thought you had a tourer, going to get my slice of pie now.
 
Could be a binding caliper. How good are you with the spanners? Might be worth stripping the brakes down and just giving them a good clean and rebuild back. Normally that resolves alot of braking problems
 
Ok I ll try to dismantle everything this weekend. Is it normal that the distance of the above posted pics are different? The pads have been replaced at the same time.
